Conditions of Use

By accessing or using KimchiMart.ph, you agree to these Conditions of Use. Kimchi Mart reserves the right to refuse, cancel, or restrict
any transaction that violates these Conditions or applicable Philippine law.
1. Account Registration
Customers must provide accurate and complete information. Each customer should maintain only legitimate accounts for personal or
authorized business use.
Kimchi Mart may suspend or terminate accounts containing false information or accounts used for fraudulent, abusive, or unauthorized
activities.
2. Orders and Fake Orders
All orders must be placed in good faith and with the intention of completing the purchase.
Customers may not place:
Fake or fictitious orders;
Orders using false names, addresses, or contact information;
Orders intended to disrupt Kimchi Mart's operations;
Repeated orders with no intention of receiving the products; or
Orders using unauthorized payment information.
Kimchi Mart may cancel suspicious orders, restrict future orders, and recover reasonable losses caused by fraudulent activity.
3. COD Orders and Refusal to Receive
For Cash-on-Delivery (COD) orders, customers are expected to receive and pay for the order when delivered.
Repeated refusal to receive a legitimate COD order without a valid reason may result in:
Suspension or termination of COD privileges;
Requirement of advance payment for future orders;
Cancellation of future orders; and/or
Restriction or termination of the customer's account.
4. Chargebacks and Payment Fraud
Customers may not initiate a fraudulent or abusive chargeback after receiving an order or after a legitimate transaction has been
completed.
Examples include:
Claiming that an order was unauthorized when it was actually authorized;
Claiming non-delivery when the order was received;
Claiming that products were not received when delivery records show otherwise;
Reversing a legitimate payment without first contacting Kimchi Mart; or
Using another person's payment method without authorization.
Kimchi Mart may investigate disputed transactions and provide relevant order, delivery, payment, communication, and account records to payment providers, financial institutions, or appropriate authorities where legally permitted.
5. Refund and Return Abuse
Customers must not intentionally misuse Kimchi Mart's refund or return procedures.
This includes:
Returning a different product from the one purchased;
Returning used, damaged, altered, or substituted products while claiming they were received in that condition;
Removing or replacing labels, packaging, or identifying marks;
Making false claims regarding damaged, missing, defective, or incorrect products;
Requesting multiple refunds for the same transaction; or
Keeping products after receiving a refund when return of the products is required.
Where appropriate, Kimchi Mart may deny the refund, recover the value of the products, suspend the account, or take other lawful
action.
6. Intentional Damage or Product Substitution
Customers must not intentionally damage, alter, contaminate, replace, substitute, or otherwise manipulate products after delivery and
then claim that the products were defective or damaged when received.
Kimchi Mart may request videos, packaging information, delivery records, product identification, or other reasonable evidence when
investigating a claim.

Where evidence reasonably indicates intentional damage, substitution, or fraudulent conduct, Kimchi Mart may deny the claim and take appropriate legal or administrative action.
7. Affiliate and Referral Fraud
Affiliate and referral participants must not manipulate the affiliate system.
Prohibited activities include:
Creating fake customer accounts;
Using multiple accounts to generate commissions;
Purchasing through one's own referral link when prohibited by the applicable affiliate rules;
Generating fictitious transactions;
Using bots or automated systems;
Manipulating referral codes;
Claiming commissions from cancelled or refunded orders;
Using misleading or unauthorized advertising;
Falsifying sales or customer information; or
Any other attempt to obtain commissions through fraudulent means.
Kimchi Mart may withhold, reverse, cancel, or recover commissions associated with fraudulent, cancelled, refunded, duplicate, or
otherwise, non-qualifying transactions.
Affiliate accounts may be suspended or permanently terminated where fraudulent activity is reasonably suspected or established.
8. Promotions and Multiple Accounts
Customers may not create multiple accounts or otherwise manipulate the system to obtain benefits intended for one customer, including:
Discount vouchers;
Free shipping;
Promotional credits;
Referral rewards;
Membership benefits;
Welcome offers; or
Other promotional incentives.
Kimchi Mart may cancel benefits obtained through abuse and restrict accounts involved in such activity.
9. Fraud and Illegal Activities
Kimchi Mart has a zero-tolerance policy toward fraud, deception, theft, and unlawful activity.
Where Kimchi Mart has reasonable grounds to suspect fraud or other unlawful activity, it may, to the extent permitted by law:
Cancel or suspend transactions;
Suspend or terminate accounts;
Withhold or reverse fraudulent rewards or commissions;
Restrict future purchases or COD privileges;
Preserve relevant records and evidence;
Recover losses caused by fraudulent activity; and
Report suspected unlawful activity to the appropriate authorities.
Fraudulent conduct may constitute estafa or another offense under Philippine law, depending on the facts and circumstances. Kimchi Mart
reserves all civil, criminal, and administrative remedies available under Philippine law.
10. Evidence and Investigation
When investigating suspected fraud, Kimchi Mart may review information reasonably related to the transaction, including:
Order history;
Account information;
Delivery records;
Proof of delivery;
Payment records;
Communications with customers;
Product videos;
Affiliate/referral records; and
Other transaction-related information.
Any collection, use, or disclosure of personal information will be handled subject to applicable Philippine privacy laws and Kimchi Mart’s
Privacy Policy.
11. Delivery and Perishable Products
Delivery dates and times are estimates and may be affected by traffic, weather, holidays, courier delays, system problems, or other circumstances beyond Kimchi Mart's reasonable control.
Customers receiving frozen or refrigerated products should promptly inspect and properly store the products after delivery.
12. Limitation of Liability
Kimchi Mart will not be responsible for delays or failures caused by circumstances beyond its reasonable control.
Nothing in these Conditions excludes or limits liability where such exclusion or limitation is prohibited by Philippine law.
13. Changes to These Conditions
Kimchi Mart may update these Conditions of Use from time to time. Updated conditions will be posted on KimchiMart.ph and become
effective when posted, unless otherwise stated.
14. Governing Law
These Conditions shall be governed by the laws of the Republic of the Philippines.
Any dispute shall be subject to the applicable laws, rules, and jurisdiction of the Philippines.
